    A Maryland judge vacated a $1.5 million judgment against DMX after his lawyers successfully argued that he was not properly served lawsuit papers. Monique Wayne, the mother of one of his children, sued the rapper for defamation after he alleged she raped him in 2003 resulting in her pregnancy. In January of this year, she was awarded the $1.5 million after the rapper, whose real name is Earl Simmons, failed to appear at the hearing.

    In 2003, Wayne became pregnant following an evening with Simmons in a Washington, D.C. hotel room. Following the child's birth in 2004, a DNA test determined that Simmons was indeed the father. In 2006, Simmons sat down with "Sister 2 Sister" magazine and told them that he was "raped" by a woman while he slept. In an attempt to clear her name, Wayne responded in an interview with the same magazine saying, "I'm mad, disappointed, embarrassed, humiliated, stressed out to capacity; sleep is not that great." According to her she did not rape the rapper. In a court hearing earlier this year she said that she woke up and found that Simmons was already on top of her, which lead to the two engaging in consensual sex. Wayne said that she decided to file the lawsuit because "he lied to the world on me." She also said, "I'm constantly getting harassed and bothered, (I'm) concerned for my son... I basically sued for my justice and my respect."

    Simmons' lawyers challenged the claim that the rapper did not show up. They maintained that he was not aware of Wayne's suit because she did not properly serve him with lawsuit papers. William "Hassan" Murphy III, one of the dark man's lawyers, said Simmons "looks forward to proving her allegations wrong" if Wayne decides to continue with the case.

    As previously reported, DMX is also facing legal trouble in Arizona. He is looking at animal cruelty and drug charges after a raid of his home by local authorities. He has pleaded not guilty and is expected back in court on July 2nd.
